Ratio Decidendi

The Court held that the agreement between FEFC members to fix prices for inland transport services as part of intermodal transport constituted a restriction of competition within the meaning of Article 85(1) EC and Article 2 of Regulation 1017/68, that the relevant market was correctly defined as inland transport services for containers, that the block exemption under Regulation 4056/86 did not apply to inland transport, that the conditions for individual exemption were not met, and that procedural rights were not breached. However, the Court found that, in light of the Commission's recent practice of not imposing fines in similar cases, the fines imposed should be annulled.
