Procedural Posture

Preliminary Reference / Final Judgment

  1. 1 Whether EU law permits a Member State to unilaterally prohibit imports of agricultural products with systematically incorrect origin labelling
  2. 2 Whether products from Western Sahara may be labelled as originating from Morocco
  3. 3 Interpretation of EU regulations on labelling and commercialisation of fruits and vegetables

Ratio Decidendi

EU law does not permit a Member State to unilaterally prohibit the importation of agricultural products solely on the basis of systematic non-compliance with EU origin labelling requirements; such measures are reserved to the European Commission. Furthermore, under EU law, the labelling of fruits and vegetables harvested in Western Sahara must indicate 'Western Sahara' as the territory of origin and may not indicate 'Morocco' as the country of origin, to avoid misleading consumers.

Court Disposition

Reference answered; import ban not permitted; labelling must indicate Western Sahara as origin.

Orders

  • Member States may not unilaterally prohibit imports of agricultural products for systematic origin labelling non-compliance.
  • Fruits and vegetables harvested in Western Sahara must be labelled as originating from Western Sahara, not Morocco.
