Ratio Decidendi

Contracting authorities are not required to disclose all information, including confidential, to a supplier challenging a tender evaluation. They must objectively assess and balance the interests of transparency and protection of confidential information, providing reasons for their decisions. Refusal to disclose confidential information may be challenged separately before courts, subject to national procedural rules, and judicial review bodies must be empowered to annul such decisions and, where appropriate, order disclosure. Directive 2016/943 does not override the specific procurement confidentiality regime in Directive 2014/24/EU.
