Procedural Posture

Joined Applications for Annulment (eu Administrative Law) / Judgment After Oral Hearing

  1. 1 Whether the Commission's decision to refuse cofinancing for certain expenditures was lawful
  2. 2 Whether the Commission breached its obligation to state reasons under Article 190 EC Treaty
  3. 3 Whether the Commission breached the principles of legitimate expectations and legal certainty

Ratio Decidendi

The Commission's decision was annulled in part because it failed to provide adequate reasons for refusing cofinancing for certain expenditures, as required by Article 190 EC Treaty and relevant case-law. The refusal to cofinance expenditures related to the Strasbourg General Assembly (except for one item) was upheld because those expenditures were neither provided for in the initial budget nor subsequently authorized, and thus the principles of legitimate expectations and legal certainty were not infringed.

Court Disposition

Application partially allowed; Commission decision annulled in part; remainder of application dismissed; no need to adjudicate in second case; Commission to bear all costs.

Orders

  • Annuls the Commission decision in Debit Note No 97009405 F (as amended) insofar as it refused cofinancing for expenditures declared ineligible, except for Strasbourg General Assembly expenditures of ECU 101,598 and ECU 256,882.
  • Dismisses the remainder of the application in Case T-46/98.
