Ratio Decidendi

State control or shareholding in a company does not, by itself, constitute significant State interference under Article 2(7)(c) of the basic regulation. The Council and Commission are required to assess the actual evidence submitted by the producer regarding its independence in commercial decision-making. The refusal to grant MET to Xinanchem solely on the basis of state control, without considering the evidence, was a legal error. Similarly, the institutions failed to properly assess the evidence regarding the CCCMC export contract stamping mechanism and its effect on export pricing. The General Court was correct in annulling the contested regulation as it applied to Xinanchem.
