Ratio Decidendi

The Commission is vested with independent discretion to scrutinise applications for registration of PGIs and is not bound by the assessments of national authorities or courts. Article 13(1)(b) of Regulation No 1151/2012 is a valid basis for refusal if the name sought evokes a previously registered PDO. The General Court did not err in law or fact in upholding the Commission's decision to reject the applications due to risk of evocation and in finding that the Commission did not exceed its powers.
