Ratio Decidendi

The United Kingdom is responsible under Article 1 of the Convention for securing the rights guaranteed by Article 3 of Protocol No. 1 in Gibraltar, including in respect of elections to the European Parliament. The European Parliament constitutes part of the 'legislature' for the purposes of Article 3 of Protocol No. 1 in Gibraltar. The complete denial of the right to vote in European Parliament elections to residents of Gibraltar impaired the very essence of the applicant's right to vote and constituted a violation of Article 3 of Protocol No. 1.

Court Disposition

Violation of Article 3 of Protocol No. 1; no need to examine Article 14; costs awarded.

Orders

  • The respondent State is to pay the applicant, within three months, for costs and expenses, 45,000 pounds sterling together with any value-added tax that may be chargeable, less 18,510 French francs to be converted into pounds sterling at the rate applicable on the date of delivery of the present judgment.
  • Simple interest at an annual rate of 7.5% shall be payable from the expiry of the above-mentioned three months until settlement.
