Article 9(3) of the Aarhus Convention, read with Article 47 of the Charter, precludes national law from denying environmental associations, authorised under national law, standing to challenge administrative decisions granting or amending EC type-approval that may contravene Article 5(2) of Regulation No 715/2007. The 'need' for a defeat device under Article 5(2)(a) must be assessed strictly, based on the state of the art at the time of approval, and only justified by immediate risks to engine protection and safe operation; other circumstances such as cost or competitiveness are not relevant.
