Ratio Decidendi

EU law, particularly Article 47 of the Charter, requires national courts to ensure effective enforcement of judicial decisions implementing clear, precise, and unconditional obligations under EU law, including Directive 2008/50. Where financial penalties are ineffective and national law provides a sufficiently clear, precise, and foreseeable legal basis for coercive detention of office holders, and such detention complies with proportionality and fundamental rights (including the right to liberty), the national court must order such detention. If no such legal basis exists in national law, EU law does not empower the court to impose coercive detention.
