Procedural Posture

Preliminary Reference / Opinion of Advocate General

  1. 1 Whether storing lawfully collected personal data in an additional internal database for technical failure without explicit consent is compatible with the GDPR's purpose limitation and storage limitation principles.
  2. 2 Whether continued retention of such data after the technical issue is resolved violates the GDPR.

Ratio Decidendi

Storing lawfully collected personal data in an additional internal database for the purpose of remedying a technical failure is not contrary to the purpose limitation principle if the processing pursues the same or a compatible purpose as the original collection, which the controller must demonstrate. However, retention of such data beyond the period necessary to resolve the technical issue, especially after the issue is resolved, violates the storage limitation principle, regardless of any ancillary contractual purpose.

Court Disposition

Opinion proposes that the Court answer: (1) Purpose limitation does not preclude parallel storage if the purpose is the same or compatible and the controller demonstrates this; (2) Storage limitation precludes retention after the technical issue is resolved, even if linked to contract execution.
