Procedural Posture

Preliminary Ruling (renvoi Préjudiciel) / Judgment

  1. 1 Whether the principle of purpose limitation under Article 5(1)(b) GDPR allows parallel storage of personal data in a test database for testing and error correction purposes.
  2. 2 Whether the principle of storage limitation under Article 5(1)(e) GDPR permits retention of personal data in a test database beyond the period necessary for testing and error correction.

Ratio Decidendi

The Court held that the principle of purpose limitation does not preclude the recording and storage of personal data in a test database for testing and error correction, provided such further processing is compatible with the original purposes for which the data were collected, as assessed under Article 6(4) GDPR. However, the principle of storage limitation precludes retaining such data in the test database for longer than necessary to perform the tests and correct errors.
