Procedural Posture

Action for Annulment (joined Cases T 369/94 and T 85/95) / Judgment of the Court of First Instance (first Chamber)

  1. 1 Whether EFDO's rejection of funding applications was lawful under the MEDIA programme and EFDO guidelines
  2. 2 Whether the Commission's interpretation of 'three different distributors' was correct
  3. 3 Whether the statement of reasons for the rejection was sufficient

Ratio Decidendi

The Court held that the Commission and EFDO were entitled to interpret 'three different distributors' as requiring independent, unconnected entities to foster new cooperation networks, in line with the aims of the MEDIA programme. The rejection of applications by UIP subsidiaries was lawful because their structure did not create new cooperation networks and, for Nostradamus, because the legal status of UIP was uncertain pending a competition exemption. The statement of reasons was found sufficient. The applications were therefore dismissed.

Court Disposition

Application in Case T-85/95 dismissed; no need to adjudicate in Case T-369/94; applicants to bear all costs.
