Ratio Decidendi

The Advocate General opined that the Spanish system, which allows repeated renewal of fixed-term contracts to cover permanent needs in the public health sector without effective time limits or sanctions, constitutes abuse under Directive 1999/70/EC. National law does not provide effective measures to prevent or sanction such abuse, and the mere possibility of participating in selection procedures is insufficient. Where no effective sanction exists, transformation to permanent or indefinite employment may be required to ensure the effectiveness of EU law.
