Procedural Posture

Preliminary Ruling (reference for Interpretation) / Judgment of the Court of Justice of the European Union (second Chamber)

  1. 1 Interpretation of Article 10(3) of Regulation (EC) No 1924/2006 regarding the requirement that references to general, non-specific health benefits must be accompanied by a specific health claim; Whether such 'accompaniment' requires spatial proximity or a clear visual link; Whether references to general, non-specific benefits must be justified by scientific evidence under Articles 5(1)(a) and 6(1) of the Regulation.

Ratio Decidendi

Article 10(3) of Regulation (EC) No 1924/2006 requires that references to general, non-specific health benefits must be accompanied by a specific health claim included in the authorised lists, and this requirement is not met if the specific claim appears only on the back of the packaging without a clear visual link (such as an asterisk) to the general reference on the front. Furthermore, such general references must be justified by scientific evidence, which is satisfied if they are accompanied by specific, authorised health claims supported by such evidence.

Court Disposition

Questions answered; interpretation provided for national court.

Orders

  • Article 10(3) of Regulation (EC) No 1924/2006 is not satisfied where a general, non-specific health benefit is referenced on the front of packaging and the specific health claim appears only on the back without a clear visual link.
  • References to general, non-specific benefits must be justified by scientific evidence; this is satisfied if accompanied by specific, authorised health claims.
