Ratio Decidendi

The Commission's Decision 2011/346/EU is valid. The Commission provided adequate reasons for finding the State guarantee to BPP constituted State aid liable to affect trade between Member States. The aid was incompatible with the internal market after the expiry of the provisional approval period, due to Portugal's failure to submit a restructuring plan and unauthorized extension of the guarantee. There was no contradiction in the reasoning regarding the dates of unlawfulness and incompatibility. The question on reduction of the recovery amount under national law was inadmissible as it was hypothetical and not relevant to the dispute.
