Procedural Posture

Application to the European Court of Human Rights / Judgment After Full Merits Hearing

  1. 1 Whether the entry and actions of police officers on the applicant organisation's premises violated Article 8 of the Convention
  2. 2 Whether the seizure of fees and taxes violated Article 1 of Protocol No. 1 to the Convention

Ratio Decidendi

The Court found that the police officers' actions constituted an interference with the applicant organisation's 'home' and 'correspondence' under Article 8. Although the actions were in accordance with domestic law and pursued a legitimate aim, the lack of adequate safeguards and absence of an effective ex post facto judicial remedy rendered the interference disproportionate and not necessary in a democratic society, resulting in a violation of Article 8. The Article 1 of Protocol No. 1 claim was inadmissible due to non-exhaustion of domestic remedies.

Court Disposition

Violation of Article 8 ECHR; Article 1 of Protocol No. 1 claim inadmissible
