Where the administrator of an information system for travel agencies sends a message capping discounts and implements technical restrictions, economic operators aware of the message may be presumed to have participated in a concerted practice under Article 101(1) TFEU, unless they publicly distance themselves, report to authorities, or rebut the presumption with other evidence. Mere dispatch of the message is not sufficient to establish awareness; national courts must assess all circumstances and respect the presumption of innocence.
