The draft revised Lisbon Agreement is essentially intended to facilitate and govern trade between the EU and third States and has direct and immediate effects on such trade. Therefore, its negotiation falls within the exclusive competence of the EU under Article 3(1) TFEU (common commercial policy), and the Council erred in basing its decision on Article 114 TFEU and in appointing Member States as negotiators. This error was not a mere formal defect but affected the substance and procedure of the decision.
