  1. 1 Whether the envisaged agreement between the EU and Canada on transfer and processing of Passenger Name Record (PNR) data is compatible with the Treaties (Article 16 TFEU) and the Charter of Fundamental Rights of the European Union (Articles 7, 8, 52(1)) as regards the right to data protection;

Ratio Decidendi

The Court held that the envisaged agreement, in its current form, is not compatible with Articles 7, 8, and 52(1) of the Charter of Fundamental Rights of the European Union, as several provisions do not meet the requirements of necessity and proportionality for interference with the right to data protection. The legal basis for the Council act must reflect both the objectives of combating terrorism/serious crime and ensuring data protection, but the agreement as drafted fails to provide adequate safeguards for fundamental rights.
