Ratio Decidendi

The Court held that the fixing of reference thresholds in Article 7 of the Single CMO Regulation constitutes a measure on fixing prices within the meaning of Article 43(3) TFEU. The reference thresholds are used exclusively as a basis for fixing intervention prices and require principally technical and scientific assessments, not policy choices reserved to the legislature. Therefore, Article 7 should have been adopted on the basis of Article 43(3) TFEU, not Article 43(2) TFEU. As Article 2 of the fixing regulation is inextricably linked to Article 7, it must also be annulled. The provisions are severable and their annulment does not alter the substance of the regulations.
