Ratio Decidendi

Directive 98/43/EC could not be validly adopted on the basis of Articles 100a, 57(2), and 66 of the EC Treaty because its general prohibition of tobacco advertising and sponsorship was not justified by the need to eliminate obstacles to the free movement of goods or services, nor by the need to eliminate appreciable distortions of competition. The Directive's centre of gravity was public health protection, which could not serve as the primary basis for harmonisation under those articles. Therefore, the Directive was annulled in its entirety.
