The evidence did not establish widespread exposure to 'hyal' as descriptive, and thus the earlier mark and the term 'hyal' should be considered to have normal distinctiveness for that public. Consequently, the Board of Appeal's finding of no likelihood of confusion and no association with a family of marks was vitiated by error, warranting annulment of the contested decision.
