The WrAuslGEG's requirements for authorisation or negative confirmation for foreign nationals acquiring immovable property constitute a restriction on the free movement of capital, but this restriction is permitted under Article 64(1) TFEU with respect to Switzerland as a third country, since similar restrictions existed under Austrian law as of 31 December 1993.
