Ratio Decidendi

The Council failed to provide timely access to the file, infringing the applicant's rights of defence, which justified annulment of Decision 2012/829 and Implementing Regulation No 1264/2012. However, the Council established to the requisite legal standard that the applicant was controlled by Babak Zanjani, justifying the restrictive measures under the decision to maintain the measures. The infringement of procedural rights did not justify annulment of the decision to maintain the measures, and the restrictive measures were proportionate to the legitimate aim pursued.
