Ratio Decidendi

Article 14(2)(b) of Regulation No 1408/71 does not apply to a person who, under successive employment contracts stating the place of employment as several Member States, in fact works during each contract only in one Member State at a time. Such a person cannot be considered 'normally employed in the territory of two or more Member States' within the meaning of that provision. The applicable legislation is determined by the place where the work is actually performed.
