Assessment of whether a sign consists exclusively of the shape necessary to obtain a technical result is not limited to the graphic representation; other objective and reliable information may be used, but not the perception of the relevant public. For the 'substantial value' exclusion, public perception may be considered to identify essential characteristics, but refusal requires objective and reliable evidence that consumer choice is determined by the shape. Design protection does not automatically preclude trade mark registration; each regime is independent and refusal under Article 3(1)(e)(iii) is not automatic for decorative items or designs.
