Ratio Decidendi

Acceptance of compensation under Regulation No 2187/93 required applicants to discontinue pending actions. The institutions were entitled to suspend payment of compensation and interest until discontinuance was effected. Interest at 8% per annum is payable for the period between discontinuance (as registered at the Court) and the date from which interest was already paid. Default interest at 6% per annum is payable on these amounts from the date of judgment.

  • Defendants to pay Günter Backhaus, Uwe Lorentz, and Manfred Mittwede interest at 8% per annum on compensation for 20 April to 28 June 1994.
