Procedural Posture

Action for Failure to Act and Alternative Application for Annulment / Final Judgment

  1. 1 Whether the Commission failed to act under Article 175 EEC by not adopting a formal decision on GEMA's complaint under Article 3(2)(b) of Regulation No 17
  2. 2 Whether the Commission's letter of 22 March 1978 constituted a definition of its position within the meaning of Article 175 EEC
  3. 3 Whether an alternative application for annulment under Article 173 EEC was admissible

Ratio Decidendi

The Commission's letter of 22 March 1978, which set out its reasons for discontinuing the inquiry and fixed a time-limit for further comments, constituted a definition of its position under Article 175 EEC. Therefore, the Commission did not fail to act, and the application for failure to act was inadmissible. The alternative application for annulment was also inadmissible as it constituted fresh conclusions not permitted under Article 42(2) of the Rules of Procedure.
