Residence conditions for Luxembourg antenatal and childbirth allowances are valid under Regulation No 1408/71, but the inclusion of the Luxembourg maternity allowance as a special non-contributory benefit in Annex IIa is invalid. The Luxembourg child-raising allowance is not a family allowance under Article 77. Invalidity pension recipients cannot claim family benefits other than family allowances under Article 77. Invalidity pension recipients residing outside the paying Member State are not workers under Regulation No 1612/68 unless rights derive from previous professional activity.
