Ratio Decidendi

Article 78(2)(b)(i) of Regulation No 1408/71 must be interpreted to mean that entitlement to benefits payable by the state of residence does not remove entitlement to greater benefits previously acquired under the legislation of another Member State alone. If the benefits in the state of residence are less, the orphan is entitled to supplementary benefits equal to the difference, payable by the competent institution of the other state.
