Ratio Decidendi

The Court found that the proceedings lasted more than twenty-six years for one level of jurisdiction, which did not satisfy the reasonable time requirement under Article 6 § 1. The domestic compensation was insufficient to remedy the breach. The applicant was entitled to further compensation for non-pecuniary damage, reduced by the amount already awarded domestically.

Orders

  • The respondent State shall pay the applicant EUR 20,200 in respect of non-pecuniary damage, plus any tax chargeable, within three months.
  • Simple interest at the marginal lending rate of the European Central Bank plus three percentage points shall be payable from expiry of the three months until settlement.
