Ratio Decidendi

The Court held that the applicant was dispensed from the obligation to exhaust domestic remedies as the time-limit for appealing to the Court of Cassation had expired before the relevant change in Italian case-law. The compensation awarded by the domestic courts was insufficient to provide adequate redress for the violation of Article 6 § 1, so the applicant retained victim status. The length of the civil proceedings was excessive and violated the reasonable time requirement under Article 6 § 1 of the Convention.
