  2. 2 Whether claims for interest constitute a 'continuous or repeated irregularity' under Article 3(1) of Regulation No 2988/95
  3. 3 When the limitation period for recovery of interest starts to run under Article 3(1) of Regulation No 2988/95

Ratio Decidendi

The limitation period in Article 3(1) of Regulation No 2988/95 applies to the recovery of both principal and interest claims arising from the same irregularity under EU law; such interest claims do not constitute a separate or continuous irregularity; the limitation period starts from the date of the irregularity (act/omission or prejudice, whichever is later); the absolute limitation period is twice the basic period; Member States may apply a longer national limitation period if the claim is not already time-barred under EU law.

Court Disposition

Questions answered; interpretation of EU law provided to national court.
