Ratio Decidendi

The Court found that the injuries sustained by the applicant during a pre-planned arrest operation were not commensurate with the circumstances, and the Government failed to convincingly show the use of force was not excessive. The investigation was not thorough or effective, as it failed to identify all relevant witnesses, did not assess the correlation between injuries and alleged resistance, and did not address allegations of ill-treatment after arrest. Accordingly, there was a violation of both the substantive and procedural aspects of Article 3 of the Convention.
