Ratio Decidendi

Regulation No 19/65/EEC was lawfully adopted under Article 87 EEC Treaty, does not require the Council to define the scope of Article 85(1) before granting exemptions under Article 85(3), and does not create a presumption that all agreements in exempted categories are prohibited. Exclusive dealing agreements may fall under Article 85(1) regardless of the economic level of the undertakings. Article 222 is not infringed as the regulation does not prejudice national property rules. The pleas of inapplicability regarding Regulations No 17/62 and 153/62 are inadmissible as those regulations are not directly applicable to the main issue.
