The Court found that for over twelve years the applicants lived in an area which, according to both legislative framework and empirical studies, was unsafe for residential use due to pollution and soil subsidence from State-owned industrial facilities. The State was aware of the situation and failed to take timely and effective measures to either reduce pollution to safe levels or resettle the applicants. This failure constituted a violation of the applicants' rights under Article 8 of the Convention.
