Ratio Decidendi

EU law confers a general right to payment of interest in all situations where sums owed under EU law are paid with delay or unduly levied, regardless of the nature of the infringement or whether it is established by national courts or the Court of Justice. Limitations imposed by EU or national law must be justified and proportionate; the Customs Code exclusion of interest applies only to normal customs clearance adjustments, not to situations where reimbursement follows judicial findings of breach. National rules limiting interest to periods after initiation of judicial proceedings are inconsistent with the principle of effectiveness.
