Article 2(2)(6) of Regulation No 1924/2006 does not require a health claim to expressly state 'significantly' for it to be a 'reduction of disease risk claim'; it is sufficient if the claim gives the impression of significant reduction to the average consumer. Article 28(2) applies only to foods bearing a trade mark or brand name considered a nutrition or health claim and existing before 1 January 2005. A commercial communication may constitute a trade mark or brand name if protected by law, subject to national court determination.
