The General Court held that the applicant failed to establish a sufficiently direct causal link between the alleged unlawful conduct (infringement of the principle of equal treatment and failure to adjudicate within a reasonable time) and the material and non-material damage claimed. The applicant's own choices (such as providing a bank guarantee rather than paying the fine in full) broke the causal link for guarantee costs. The applicant did not prove it personally suffered loss of profit or reputational damage, and any non-material damage was sufficiently remedied by the annulment and reduction of the fine by the Court of Justice.
