Ratio Decidendi

The Board of Appeal correctly found that the goods covered by the marks are similar, that the signs are visually and phonetically similar to an average degree, and that the relevant public's level of attention, while higher than average, does not preclude a likelihood of confusion. The applicant's arguments do not undermine the Board's global assessment. Therefore, there is a likelihood of confusion under Article 8(1)(b) of Regulation No 207/2009.
