The additional amount under Article 1 of Regulations (EEC) No 796/81 and No 1755/81 must be levied where preserved mushrooms are released into free circulation without a valid import licence, even if discovered after release. However, the level of the additional amount fixed by those regulations is invalid as it is disproportionate to the objective pursued, particularly as it does not differentiate according to the quality or origin of the goods and imposes a considerable financial charge exceeding what is necessary for market protection.
