The Court held that the Commission's decision was valid. The administrative procedure respected the rights of defence, and the measures adopted by FEDETAB and its members were not exempt from notification as they involved undertakings from more than one Member State and more than two undertakings. The notification requirements were not met because the prescribed form was not used. The Commission was not required to discuss every argument in detail, and the recommendation was binding and fell under Article 85(1).
