Ratio Decidendi

The Board of Appeal erred in finding that 'HELL' is descriptive for the goods in question, as there is no sufficiently direct and concrete link between the sign and the characteristics of the coffee products; the term does not immediately describe a characteristic of the goods for the relevant public. Consequently, the finding of lack of distinctiveness based solely on alleged descriptiveness is also unfounded.

Appeal allowed; contested decision annulled

  • The decision of the EUIPO Board of Appeal of 25 March 2020 (Case R 1712/2019-2) is annulled.
