Ratio Decidendi

The Estonian authorities failed to demonstrate due diligence in the adoption proceedings by not taking into account the applicant's pending paternity proceedings in Latvia, nor did they balance the applicant's interests as biological father with those of the child and other parties. The annulment proceedings also failed to provide relevant and sufficient reasons for excluding the applicant, especially after his paternity was recognised in Latvia. This amounted to a violation of Article 8 of the Convention.

Court Disposition

Violation of Article 8 of the Convention found against Estonia.

Orders

  • Estonia is to pay the applicant EUR 7,500 in respect of non-pecuniary damage within three months.
