Ratio Decidendi

The Court held that the concept of 'regulatory act' in Article 263(4) TFEU does not encompass legislative acts. Therefore, natural or legal persons may only challenge legislative acts if they are both directly and individually concerned. The appellants failed to meet the requirement of individual concern, as the contested regulation applies in general terms to all traders and does not distinguish the appellants individually. The General Court did not err in law or breach the obligation to state reasons, nor was there a violation of the right to effective judicial protection, as alternative remedies exist under EU law.
