Procedural Posture

Preliminary Ruling / Opinion of Advocate General

  1. 1 Whether Decision 2000/128/EC applies to an employer operating local public transport services on a substantially non-competitive basis
  2. 2 Whether reductions in social security contributions for ANM constitute State aid affecting trade between Member States and distorting competition under Article 107(1) TFEU

Ratio Decidendi

Decision 2000/128/EC is applicable to an employer such as ANM, which operated local public transport services and benefited from reductions in social security contributions, unless it benefited from a legal monopoly reserved by law or regulation in compliance with Union law and did not operate on any other geographic or product/service market. The mere local or exclusive nature of the service does not preclude the possibility that the aid affected trade between Member States or distorted competition.

Court Disposition

Preliminary ruling proposed: Decision 2000/128/EC applies to ANM unless it benefited from a legal monopoly and did not operate on other markets.
