Community law does not prohibit a Member State from imposing a three-year limitation period for actions seeking repayment of charges levied in breach of EU law, provided the rule applies equally to actions based on national and EU law. Nor does Community law prevent the limitation period from running from the date of payment, even if the directive was not yet transposed, unless the claimant is deprived of any opportunity to enforce rights.
