The applicant was denied access to a court to challenge the refusal to institute transfer proceedings under Article 11 of the Transfer Convention, following an assurance by the Public Prosecutor that influenced his confession and conviction. The Government failed to demonstrate the existence of an effective legal remedy. This constituted a violation of Article 6 § 1 (right of access to court) of the Convention.
