Ratio Decidendi

The interference with the applicant's right to respect for his private life and correspondence was not accompanied by adequate and effective guarantees against abuse, as there was no legal framework or independent supervision for persons randomly affected by telephone tapping. The remedies available were ineffective, and the applicant could not challenge the warrant or its implementation. Therefore, the interference was not in accordance with the law for the purposes of Article 8 § 2 of the Convention.
