The Board of Appeal did not err in finding that the forms in which the earlier mark was used did not alter its distinctive character, thus establishing genuine use. The Board of Appeal correctly found that the relevant public includes both professionals and the general public with a high level of attention. The services at issue are in part identical and in part similar. The signs are visually, phonetically, and conceptually similar. There is a likelihood of confusion within the meaning of Article 8(1)(b) of Regulation 2017/1001.
